General Conditions of Sale and Privacy Policy

OWNERSHIP, PURPOSE AND SCOPE OF APPLICATION

www.ajogar.com and any commercial transactions carried out by individuals, as end consumers, hereinafter referred to as “customers”, through the online store at www.ajogar.com .
It is considered that by browsing the website, as well as by placing any orders, the customer is accepting these general terms and conditions of sale.

The service provided consists of making available, through the address www.ajogar.com, information relating to a set of products in order to allow the customer, electronically or by telephone, to order the products advertised therein, under the terms and conditions described herein.
Orders for products must be made by customers aged 18 (eighteen) or over (individuals under this age require authorization from their legal representative). The elements and information transmitted by the customer will have full legal effect, with the customer recognizing electronic purchases, and the customer may not claim the lack of signature as a reason for failure to comply with the obligations assumed.

The website www.ajogar.com is intended exclusively for private use, therefore the reproduction, transfer, distribution or storage of its contents is prohibited for any purpose other than strictly personal use. These General Terms and Conditions of Sale apply to visitors to the website.

PRODUCTS AND CONTENT

In the Ajogar.com online store we will try to ensure that the information presented is always up to date regarding the products and content found therein. The images presented are merely illustrative and may not entirely match the product, so we recommend that you carefully consult the details of the product sheet for more information about the respective characteristics of the item(s) you wish to purchase.

Whenever there is any inconsistency between the order and the product stock, the customer is immediately alerted with information about new deadlines, exchange possibilities or the right to cancel the purchase, with the appropriate refund.
All information about prices, products, promotions and services may be changed at any time, with immediate effect.
The prices shown on this website are in euros, including VAT.

ORDERS AND SHIPPING

Placing an order presupposes that the customer provides their personal data such as name, full address, telephone number and email address.
Orders are only processed and shipped after payment confirmation by our systems, stock validation and payment order.
Delivery fees are the responsibility of the customer and will be charged at the end of the order, depending on the purchase volumes, delivery address and will be subject to validation by the selling party.
All orders, when in stock, will be shipped to the customer, by carrier, within 3 to 5 working days. After shipping, delivery times depend exclusively on the responsibility of the carrier company.

In the event of any mistake on the part of the customer regarding the shipping address, contact or failure to collect the order that makes it impossible to deliver the order, the return shipping costs are the sole responsibility of the buyer, for a minimum value of €3.

The Customer may choose to collect the order in person at the following address: Rua Joaquim Maria de Melo 244 Vila do Conde, without any associated cost and during the opening hours of our premises. To collect the order, it will be necessary to present proof of delivery in digital or paper format.

The use of a discount coupon cannot be combined with any other promotions or discounts. Each coupon has an associated validity period and may be subject to other conditions as described in its offer.

Ajogar.com only sells to mainland Portugal and islands.

Ajogar.com reserves the right to cancel any order in the following situations, exempt from liability for any damages or costs:

  • The product is no longer available (the customer will be refunded);
  • The billing information is not correct or verifiable;
  • Payment is not received within 1 business day after acceptance of the order;
  • If there are indications that the customer is not an end consumer;
  • If we detect that the price indicated on the website is wrong.
  • If it is not possible to deliver the order to the respective address.

ORDERS DAMAGED IN TRANSPORTATION

Upon receiving an order, the customer must check the packaging and, if any anomaly is detected (deterioration, tampering, cutting), the customer must immediately refuse the order to the courier responsible for delivery, indicating in the delivery record that the order was refused due to damage. The customer must also inform us of the incident.
Failure to comply with this rule will deprive the customer of any subsequent claim.

RESERVATION OF OWNERSHIP OF MARKETED PRODUCTS

The Ajogar.com store retains ownership of the products until it has received full payment for them, including shipping costs, and will regain ownership of the products purchased by the customer if they are considered abandoned. Products are considered abandoned:

  • in the case of “Collection on Site”, after the 2-month period after the customer was informed electronically that the order was ready for collection;
  • in the case of “Postal Shipping” the order has not been received and consequently returned to the seller, after a period of 2 months from the customer having been informed of the occurrence electronically, with the request for a new shipping address and the payment of a new shipping fee which, in any situation, will always be borne by the customer.

RETURNS

If you wish to return an item, you have 30 days after receiving the product to do so. In these cases, the return shipping costs are entirely the responsibility of the customer. To make a return, you must send an email to geral@ajogar.com with this information.
Returns will only be accepted for items in their original packaging, sealed and without any damage. Once these conditions have been met, the amount will be refunded using the same payment method used by the customer. Initial shipping costs will not be refunded.

APPLICABLE LAW AND COMPETENCE

Portuguese law applies to these General Conditions of Sale.

In the absence of resolution by agreement between the parties, any dispute arising from the General Conditions of Sale mentioned above will be submitted to the competent Portuguese court.
